Changes to Tourist-Use Homes Regulations: Decree Law 9/2024

If you’re renting out a property in the Valencian Community for short-term tourism, it’s essential to be aware of the latest changes introduced by Decree Law 9/2024. These modifications impact how tourist-use homes are regulated.

But first, what exactly are tourist-use homes?

What Are Tourist-Use Homes?

Tourist-use homes are properties rented out for short-term tourism purposes. Specifically, they are:

  • Available for immediate occupancy and rented for a period of 10 days or less to the same tenant.
  • Must have a favourable municipal report confirming their suitability for tourist use.
  • These properties must be rented in their entirety—renting individual rooms is not allowed.

 

Additionally, to meet compliance:

Each tourist-use home must be associated with a unique cadastral reference, which helps with the identification and physical location of the property.

The exact location of the property should be clearly stated, and a tourist home emblem with the registration number and Valencian Community logo must be displayed.

 

How Long Is the Registration Valid?

Registration in the Tourism Register is valid for five years. After this period:

To continue operating, property owners must submit a new responsible declaration for renewal with the express consent of the owner.

This must be done within the month prior to the expiration of the registration period.

 

Property Conditions and Requirements

To comply with the new regulations, tourist-use properties must meet the following conditions:

  • The property should adhere to minimum size requirements for residential-use properties, ensuring adequate lighting and ventilation.
  • Emergency instructions must be available in multiple languages, and an evacuation plan should be visible near the entrance.
  • If the property is located on the fourth floor or higher, it must have an elevator. For ground-floor units, there should be a separate entrance for clients.
  • A 24-hour customer service phone line must be provided for tenants.

 

Obligations for Tourist-Use Homes

Property owners have several key obligations under this new regulation:

  • Obtain a municipal report confirming urban compatibility.
  • Submit a new responsible declaration every 5 years.
  • Provide a certificate from the homeowners’ association, confirming there are no objections to using the property for tourist rentals.
  • Establish internal regulations, covering community rules, service usage, and pet policies.

 

Prohibitions Under the New Law

The decree law also introduces several prohibitions:

  • Renting individual rooms within a property is prohibited.
  • Renting out properties for more than 10 days to the same tenant is not allowed.
  • The use of lockboxes in public spaces for key handovers is strictly prohibited.
