Dealing with Incapacity
Unfortunately if someone cannot manage their own affairs then an Administrator in Spain needs to be appointed and we can assist with this process. Or if an individual has been appointed with a Lasting Power of Attorney, action can be taken in Spain using this once it has been legalised and translated.
The incapacitated person´s assets should be protected by obtaining a court order that can be registered at the Land Registry. Even if the incapacitated person is not in Spain, but has Spanish assets or interests, a foreign order can be enforced at the Spanish Courts. If you have been appointed as a deputy of a incapacitated person and you wish to sell a property in Spain, we can assist you with all the aspects of the legal process.
Asset Searches
Searches can be carried out nationally to ascertain if someone had Spanish assets or if they were a director of a Spanish company. In addition with the relevant authorisations we can contact and liaise with Spanish banks to ascertain if the deceased had a Spanish bank account.
